1. Introduction and Acceptance
Welcome to Kinzoo Together.
Kinzoo Together is a video calling service designed for families — especially for grandparents to stay connected with grandchildren, and for extended families to share moments across distance. It is made by Kinzoo Technologies Inc. ("Kinzoo," "we,""our," or "us"), a Canadian company.
These Terms of Use ("Terms") govern your use of Kinzoo Together, including the iOS app, Android app, and any web-based version we may provide. By creating an account or using the service, you agree to these Terms.
These Terms apply solely to Kinzoo Together and are separate from the terms governing any other Kinzoo products.
If you use Kinzoo Together in a way that involves a child, you are agreeing to these Terms on behalf of yourself and represent that the child is participating with appropriate adult oversight as described in these Terms.
If you do not agree to these Terms, do not use Kinzoo Together.
We may update these Terms from time to time. For material changes, we will notify you by email or in-app notice. Your continued use after notice of a change means you accept the updated Terms.
2. Account Types and Eligibility
Kinzoo Together has two profile types, selected at sign-up:
2.1 Adult Profile
An Adult profile is for users 18 and older. Adults may:
- Initiate and host video call sessions
- Invite other adults and children to join calls
- Subscribe to a paid plan
- Manage their own account settings
Adults are responsible for their own use of the service and for any child users they invite into calls.
Users aged 13–17 may use Together with the oversight of a parent or guardian who holds responsibility for their participation. By using the service as a 13–17 year old, you represent that your parent or guardian is aware of and has consented to your use.
2.2 Kid Profile
A Kid profile is for child users. Children select "Kid" as their profile type at sign-up. Kids:
- Join calls via invite from an adult
- Have only their first name on their profile
- Do not have access to billing, account management, or settings beyond their profile
Kinzoo Together is not a standalone independent service for children. Child participation is designed around adult-initiated calls within a family context.
3. Account Setup for Child Users
3.1 Current Sign-Up Flow
Kinzoo Together's sign-up process includes email verification for adult users and if the user selects "Kid" at sign-up, only their first name is collected. Children join calls via invite from an adult session host. The adult who creates the call session is responsible for who they invite.
3.2 What Adults Are Responsible For
The adult who invites a child into a Kinzoo Together call is responsible for:
- Ensuring they have appropriate authority (as a parent, guardian, or with parental permission) to allow the child to participate
- Ensuring the child's participation is safe and appropriate
- Complying with these Terms on behalf of the child
3.3 Parental Rights
Parents and guardians may at any time:
- Request to review what data Together holds about their child
- Request deletion of their child's account and data
- Contact us to revoke consent for their child's participation
To exercise these rights, contact us at privacy@kinzoo.com. We will respond within 30 days.
4. Acceptable Use
4.1 What Kinzoo Together Is For
Kinzoo Together is designed for:
- Family video calls between adults and children
- Staying connected across generations and distances
- Safe, private, family-to-family communication
4.2 You Agree Not To
You agree not to use Kinzoo Together to:
- Harass, bully, threaten, or harm anyone
- Exploit, abuse, or groom children in any way
- Share content that is illegal, obscene, hateful,or harmful
- Impersonate another person
- Attempt to contact children outside the context of an adult-initiated call
- Gain unauthorized access to accounts, systems, or data
- Use bots, automated tools, or scripts to interact with the service
- Violate any applicable local, national, or international law
- Circumvent Kinzoo's safety features
- Collect data about other users without their knowledge or consent
- Interfere with the integrity or performance of the service
4.3 Account Responsibility
You are responsible for all activity under your account. Keep your credentials secure and do not share them. If you suspect your account has been compromised, notify us immediately at support@kinzoo.com.
5. Advertising
5.1 Our Advertising Approach
Kinzoo Together uses contextual advertising only. This means:
- Ads are served based on the general context of the app (for example, the "family video calling" category) — not based on your personal profile, behavior, or history
- No behavioral targeting for any user — adult or child
- No user profiling for advertising purposes — no advertising profile is built for any user
- No interest-based advertising — we do not track users across apps or websites
- No cross-app tracking for advertising purposes
This is a platform-wide commitment. It applies equally to adults and children.
5.2 Who Sees Ads
- Adult users on the free tier: Will see contextual ads
- Child users on the free tier: Will see contextual ads
- Subscribers (paid tier): No ads
5.3 Our Advertising Commitments
Regardless of any change to ad format or delivery:
- Advertising will never be behavioral, interest-based, or targeted based on any user's personal data
- No child user data is used for any advertising purpose
- No child user data is shared with advertising partners
- All ads are clearly labeled as advertisements
- No manipulative advertising techniques will be used (no dark patterns, countdown pressure, false urgency)
- Ad partners are contractually prohibited from profiling Kinzoo Together users
5.4 Ad-Free Option
Paying subscribers on an individual plan see no advertising. There is no family subscription plan. Subscriptions are individual — each account holder manages and pays for their own subscription.
5.5 Your Choices
- Subscribe to an individual paid plan to remove all advertising.
- GPC signal: We honor Global Privacy Control (GPC) signals as an opt-out of data sale/sharing under CCPA/CPRA.
- Device-level ad settings: You can reset or limit your advertising identifier through your iOS or Android device settings.
6. Subscription and Billing
6.1 Free and Paid Tiers
Kinzoo Together is available in a free tier and a paid individual subscription tier.

There is no family subscription plan. Subscriptions are individual accounts only.
6.2 Subscription Plans
Paid subscriptions are available on a monthly or annual basis. Current pricing is shown in the app and at togetherapp.kinzoo.com.
6.3 Billing
Payments are processed through the Apple App Store, Google Play, or our payment processor. We do not store your credit card information. By subscribing, you authorize recurring charges to your chosen payment method.
6.4 Free Trials
If we offer a free trial, you will be charged at the end of the trial period unless you cancel before it ends. We will remind you before the trial expires.
6.5 Cancellation
You may cancel at any time through your account settings or the applicable app store. Cancellation takes effect at the end of the current billing period. You retain access to the paid tier until then. We do not provide prorated refunds for partial billing periods, except as required by applicable law.
6.6 Refunds
EXCEPT AS OTHERWISE STATED HEREIN OR REQUIRED BY APPLICABLE LAW, YOUR PAYMENT IS NONREFUNDABLE. If you cancel your subscription, you will not receive any refund and you will continue to have access to the subscription services through the end of the subscription period. We reservet he right to issue refunds, credits, or discounts at our sole discretion. If we issue a refund, credit, or discount, we are under no obligation to issue the same or similar refund in the future and we may terminate your subscription and access to the Services.
EU/UK users: You may have a statutory 14-day right of withdrawal for digital services under EU/UK consumer law. By agreeing to these Terms and immediately beginning to use the paid tier, you acknowledge that the right of withdrawal may not apply once service has commenced. We will be clear about this before you subscribe.
6.7 Price Changes
We will give you at least 30 days' notice of any price change by email or in-app notification. Your continued subscription after a price change takes effect constitutes acceptance of the new price. If you do not accept, you may cancel before the change takes effect.
7. Child Safety Standards
Child safety is not a legal checkbox — it is a core requirement. We apply zero tolerance to child sexual abuse and exploitation (CSAE).
7.1 Zero-Tolerance Policy
The following conduct will result in immediate account termination, reporting to law enforcement, and reporting to the National Center for Missing & Exploited Children (NCMEC) via CyberTipline as required by law:
- Sharing, requesting, or producing child sexual abuse material (CSAM) of any kind
- Grooming — any attempt to gain the trust of a child for the purpose of exploitation
- Soliciting sexual content from or exposing sexual content to a child
- Any attempt to establish contact with a child that violates the intent of the family call context
This policy applies to all users without exception.
7.2 How We Protect Children
- Invite-only by design: Child users can only join calls they have been specifically invited to by an adult session host. Strangers cannot reach child users.
- No public child profiles: Child profiles are not discoverable outside of calls they are invited to.
- Safety reporting: Any user can report a safety concern in the app. Reports are reviewed promptly.
- No recording: Kinzoo Together does not record or store call content. No video, audio, or biometric data is retained from any call.
7.3 Reporting
If you witness conduct on Kinzoo Together that endangers a child:
- Contact local law enforcement if a child is in immediate danger
- Submit a report to the NCMEC CyberTipline at www.missingkids.org
Kinzoo will cooperate fully with law enforcement investigations involving child safety.
8. Content and Conduct
8.1 Call Content
Kinzoo Together is a live video calling service. Call content is not recorded or storedby Kinzoo. We do not retain video, audio, or any biometric data from calls.
8.2 Profile Content
To the extent you provide profile content (for example, a display name or profile photo), you represent that you own or have the right to use that content and that it does not violate anyone's rights or these Terms.
8.3 No Recording Without Consent
You may not record calls made through Kinzoo Together without the knowledge and consent of all participants. Recording without consent may violate applicable wiretapping, eavesdropping, or privacy laws in your jurisdiction.
8.4 Respectful Conduct
Kinzoo Together is a family space. Bullying, harassment, hate speech, or conduct a reasonable person would find offensive or harmful is not permitted. This standard applies to all users.
9. Intellectual Property
9.1 Kinzoo's Intellectual Property
All content, trademarks, logos, software, and designs associated with Kinzoo Together are owned by Kinzoo Technologies Inc. or its licensors. Your use of the service does not grant you any ownership or license rights to Kinzoo's intellectual property except the limited right to use the app for its intended purpose under these Terms.
9.2 Your Content
You retain ownership of any content you provide (display name, profile photo). By providing content, you grant Kinzoo a limited, non-exclusive license to use it to deliver the service to you. We do not claim rights to your call content — which is not recorded or stored.
9.3 DMCA / Copyright
If you believe content on our platform violates your copyright, contact us at copyright_agent@kinzoo.com with a description of the work, the allegedly infringing content, and your contact information. We will investigate and respond in accordance with the Digital Millennium Copyright Act (DMCA) and applicable law.
10. Third-Party Links and Services
Kinzoo Together may contain links to third-party websites or services. We are not responsible for the privacy practices or terms of those third parties. We encourage you to review their policies before providing them with information.
We do not knowingly direct child users to third-party websites or services that do not comply with applicable children's privacy laws.
11. Termination
11.1 Your Right to Terminate
You may close your account at any time through the app's account settings or by contacting us at support@kinzoo.com. Closing your account results in deletion of your data in accordance with our Privacy Policy.
11.2 Our Right to Terminate or Suspend
We may suspend or terminate any account, with or without notice, for:
- Violation of these Terms
- Conduct that threatens child safety
- Fraudulent, illegal, or abusive activity
- Extended inactivity (we will provide notice before deleting inactive accounts)
- Technical, security, or business reasonsrequiring us to discontinue the service
For serious violations — particularly any violation of Section 7 (Child Safety) — termination will be immediate and without prior notice.
11.3 Effect of Termination
Upon termination:
- Your access to the service ends immediately
- Your data will be deleted in accordance with our Privacy Policy
- Any remaining paid subscription period will not be refunded (except as required by applicable law)
- Sections of these Terms that by nature survive termination will continue to apply (including Sections 9, 12, and 13)
12. Disclaimers and Limitation of Liability
12.1 Service Provided "As Is"
Kinzoo Together is provided on an "asis" and "as available" basis. We work hard to maintain are liable service but cannot guarantee it will be uninterrupted, error-free, or secure at all times.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINZOO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINZOO'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF:
(A) THE TOTAL AMOUNT YOU PAID KINZOO IN THE 12 MONTHS BEFORE THE CLAIM; OR
(B) CAD $100.
KINZOO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Consumer law note (EU/UK): Nothing in this Section limits statutory rights you may have as a consumer under EU or UK law, including rights relating to defective digital products. Mandatory consumer protections apply regardless of these Terms.
Quebec note: Certain limitations of liability may not apply to Quebec residents to the extent they conflict with Quebec consumer protection law.
12.3 Third-Party Conduct
We provide tools for families to connect safely but cannot guarantee the conduct of other users. If you experience harmful conduct, report it to us immediately and, where appropriate, to law enforcement.
13. Dispute Resolution
13.1 Informal Resolution First
If you have a dispute with Kinzoo, please contact us at privacy@kinzoo.com and give us 30 days to try to resolve it informally. Many concerns can be resolved quickly.
13.2 Binding Arbitration (US Users)
This section applies to users in the United States.
If informal resolution fails, you and Kinzoo agree to resolve disputes through binding individual arbitration, not in court, except as noted in Sections 13.3 and 13.4. You are waiving your right to a jury trial and to participate in a class action.
Arbitration rules:
- The arbitration will be administered by NAM and resolved before a single arbitrator. If NAM is not available to arbitrate, the parties will select an alternative arbitration provider, but in no event shall any arbitration be administered by the American Arbitration Association. Except as modified by this “Dispute Resolution” provision, NAM will administer the arbitration in accordance with the NAM Comprehensive Dispute Resolution Rules and Procedures, Fees For Disputes When One of the Parties is a Consumer and the Mass Filing Dispute Resolution Rules and Procedures in effect at the time any demand for arbitration is filed with NAM, excluding any rules or procedures governing or permitting class or representative actions. The applicable NAM rules and procedures are available at www.namadr.com or by emailing National Arbitration and Mediation's Commercial Dept at commercial@namadr.com.
- Location: your county of residence, or by video/phone by mutual agreement
Class action waiver: Disputes must be brought individually. Class, collective, or representative actions are not permitted.
Small claims exception: Either party may bring qualifying claims in small claims court.
13.3 Quebec Residents — Arbitration Carve-Out
Quebec residents are not subject to the binding arbitration clause above. Quebec's Code of Civil Procedure and consumer protection laws govern dispute resolution for Quebec residents. Disputes may be brought before the competent courts in Quebec.
13.4 EU and UK Residents — Arbitration Carve-Out
Nothing in these Terms removes or limits the rights of consumers in the EU or UK to bring claims before the courts of their country of residence. EU residents may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. UK residents may be able to refer a complaint to an applicable Alternative Dispute Resolution (ADR) scheme.
The arbitration clause in Section 13.2 does not apply to EU or UK users to the extent it would be unenforceable under applicable consumer protection law.
13.5 Governing Law for Disputes
- US users: Federal Arbitration Act governs the arbitration clause
- Canadian users (outside Quebec): Ontario law governs
- Quebec users: Quebec law governs
- EU/UK users: Consumer protection laws of your country of residence may apply
14. Governing Law
14.1 General
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there in, without regard to conflict of law principles.
14.2 Jurisdiction
Subject to the arbitration clause and applicable carve-outs, legal proceedings arising out of these Terms will be brought in the courts of Ontario, Canada. EU and UK consumers may also bring proceedings in the courts of their country of residence.
14.3 EU and UK Mandatory Consumer Protections
Nothing in these Terms removes mandatory consumer protections applicable to users in the EU or UK under their local laws.
15. General Provisions
15.1 Entire Agreement
These Terms, together with the Kinzoo Together Privacy Policy, constitute the entire agreement between you and Kinzoo regarding your use of Together.
15.2 Severability
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, without affecting the rest of the Terms.
15.3 No Waiver
Our failure to enforce any right or provision is not a waiver of that right or provision.
15.4 Assignment
Kinzoo may assign these Terms to a successor company (e.g., in a merger or acquisition). We will notify you of any material assignment. You may not assign your rights or obligations without Kinzoo's written consent.
15.5 Force Majeure
Kinzoo is not liable for delays or failures resulting from causes beyond our reasonable control, including natural disasters, pandemics, power outages, internet infrastructure failures, or government actions.
15.6 Language (Quebec)
In the province of Quebec, both parties confirm they have requested that this agreement and related documents be drawn up in English. Les parties reconnaissent avoir demandé que cette convention et les documents qui s'y rattachent soient rédigés en anglais.
